Overview

These Terms of Service ("Terms") form a binding agreement between you and Niddo Team ("Niddo Team", "we", "us", or "our") and govern your access to and use of the Niddo mobile application and related services (collectively, the "App" or "Services").

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Eligibility

The Services are intended for users aged 17 and above. By using the Services, you represent that you are at least 17 years old and that you have the legal capacity to enter into these Terms.

2) Accounts and User Information

You may need to create an account to use certain features. You agree to provide accurate information (such as name, username, and email address) and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3) Your Content and Permissions

3.1 Your Content

"User Content" means content you submit or make available through the Services, such as photos, text, voice notes, and other materials.

You retain ownership of your User Content. You grant Niddo Team a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and process your User Content solely to provide and operate the Services (including generating image cards or processing voice notes) and to maintain, secure, and improve the Services.

3.2 Permissions

The App may request device permissions (such as photos/camera, microphone for voice notes, and location). You can control permissions through your device settings. Some features may not work without certain permissions.

4) AI-Assisted Features (If Available)

Some features may provide AI-assisted generation or enhancement (for example, turning photos and text into stylized literary image cards). When you choose to use these features:

• You control whether to upload any content for processing.
• Uploaded content is processed on servers controlled by Niddo Team and is not shared with third parties for AI processing.
• Content submitted for one-time processing is deleted promptly after processing is completed, consistent with our retention practices.

AI outputs may vary in quality and may not be accurate or suitable for all purposes. You are responsible for reviewing and deciding whether to use or share any generated output.

5) Acceptable Use

You agree not to:

• Use the Services for unlawful, harmful, or abusive purposes.
• Upload content that infringes intellectual property rights or violates privacy or publicity rights of others.
• Upload content that is obscene, defamatory, hateful, or otherwise illegal.
• Attempt to reverse engineer, disrupt, or compromise the Services, including bypassing security features.
• Use the Services to develop or distribute malware, or to scrape or harvest data without authorization.

We may remove content or restrict access if we reasonably believe you violated these Terms or applicable law.

6) Intellectual Property

The Services, including software, designs, trademarks, and other materials provided by Niddo Team (excluding User Content), are owned by Niddo Team or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services unless expressly permitted in writing by Niddo Team.

7) Third-Party Services

The Services may allow you to share content via third-party platforms or access third-party services. Your use of those services is governed by their terms and policies. Niddo Team is not responsible for third-party services.

8) Privacy and Data Practices

We collect and use certain information to operate the Services (for example, account data, device data, usage analytics, crash logs, and location if you enable it). We do not sell personal information. We use reasonable security measures and retain data only as needed for operational, support, legal, and safety purposes.

9) Changes and Updates

We may modify the Services or these Terms from time to time. If changes are material, we will make reasonable efforts to provide notice (for example, through the App or by updating the effective date). By continuing to use the Services after changes take effect, you agree to the updated Terms to the extent permitted by law.

10) Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or to protect the Services, users, or Niddo Team.

11) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. NIDDO TEAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIDDO TEAM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN ALL CASES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIDDO TEAM'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID TO NIDDO TEAM FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13) Indemnification

You agree to indemnify and hold harmless Niddo Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Services, or your violation of these Terms or applicable law.

14) Governing Law

These Terms are governed by the laws of Niddo Team's primary place of business, excluding conflict-of-law rules.

15) Binding Arbitration and Dispute Resolution

Please read this section carefully. It affects your rights.

You and Niddo Team agree to resolve disputes through binding arbitration, except where prohibited by law or where either party may bring an individual claim in small claims court (if applicable).

15.1 Informal Resolution First

Before initiating arbitration, you agree to contact us at jmjmgbfb537316@outlook.com and attempt to resolve the dispute informally. We will respond within a reasonable time.

15.2 Arbitration

If informal resolution is unsuccessful, disputes will be finally settled by binding arbitration conducted by a neutral arbitrator. The arbitration will be conducted in English. The arbitrator may award the same remedies a court could award, to the extent permitted by law.

15.3 No Class Actions

To the maximum extent permitted by law, you and Niddo Team agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

16) Miscellaneous

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
• Entire Agreement: These Terms constitute the entire agreement between you and Niddo Team regarding the Services.
